Wealth attracts risk. Professionals, business owners, and investors in Palm Beach face exposure to lawsuits, creditor claims, and business liabilities that can threaten a lifetime of accumulated assets. Florida offers some of the strongest asset protection laws in the nation, and a well-designed plan puts those protections to work before any claim arises.
Florida’s Built-In Protections
Several Florida protections apply automatically or by titling. The Florida Constitution shields homestead property from most creditors, with no dollar limit but with acreage limits of one-half acre within a municipality and up to 160 acres outside one. Florida statutes protect the cash value of life insurance, annuity contracts, and qualified retirement plans, and tenancy by the entirety ownership can shield assets owned by a married couple from the individual debts of one spouse.
Irrevocable Trusts
For protection beyond the statutory exemptions, irrevocable trusts under Chapter 736 can remove assets from your reach and from creditors. Because you give up control, these trusts must be planned carefully to balance protection against your need for access and flexibility. We structure trustee powers, distribution standards, and beneficiary provisions to achieve durable protection while keeping the plan workable.
Timing and Fraudulent Transfer Rules
Asset protection must be proactive. Florida’s Uniform Fraudulent Transfer Act allows creditors to unwind transfers made to hinder, delay, or defraud them. Transfers made after a claim has arisen, or when one is foreseeable, are vulnerable to challenge. Effective planning is done while the seas are calm, long before any lawsuit or financial trouble appears on the horizon. We will not assist with transfers intended to defraud existing or known creditors.
Business and Entity Structuring
For clients with operating businesses or investment real estate, the entity structure matters. Limited liability companies and limited partnerships can compartmentalize liability and, when properly maintained, limit a creditor’s remedy against an ownership interest. We coordinate entity planning with your trusts and estate documents so the structure holds together.
Integrating Protection With Estate Planning
Asset protection should never stand alone. We weave it into your overall estate plan so that your revocable trust, will under Section 732.502, durable power of attorney, and tax strategy all reinforce one another. The result is a structure that protects you during life and transfers wealth efficiently at death.
Preserving Homestead Through Generations
Florida homestead carries devise and descent restrictions when a spouse or minor child survives, which can complicate transfers. We plan homestead ownership and disposition so that its powerful protections survive, while honoring Florida’s constitutional and statutory limits.
